COMMERCIAL DRIVER’S LICENSE
Ross & Calaway L.L.C. have successfully defended Commercial Driver’s License (CDL) holders and truckers on everything from speeding citations to OVI/DUI/DWI.
We know that your livelihood depends on your ability to drive. We fight hard to keep the points off your driving record and you behind the wheel.
We have successfully gotten speeding tickets dismissed or the charges amended to non-moving violations that carry no points on your driver’s license and keep your insurance rates low.
If you are a CDL driver and are charged with an OVI/DUI/DWI – even if you are in your personal vehicle and” off the clock” at the time – you face tougher penalties and driving restrictions than for non-CDL drivers. For example, if you are convicted or found guilty of an OVI/DUI/DWI, you will lose your CDL license for 1 year mandatory. If you have a prior OVI/DUI/DWI and are arrested again for OVI/DUI/DWI, you face a mandatory LIFETIME disqualification of your CDL.
If you are stopped and arrested for OVI/DUI/DWI and refuse to submit to a chemical test, such as a breath, blood or urine test, you will also lose your CDL for 1 year on a first-offense. An arrest for OVI/DUI/DWI also means that you cannot get limited driving privileges to drive a commercial vehicle for work!
Literally, an arrest for OVI/DUI/DWI could mean your job and even your career as a commercial driver. The law may affect you even if you currently do not have a CDL, but are thinking of getting a CDL sometime in the future. Even common reductions from OVI/DUI/DWI such as Reckless Operation, Physical Control or Marked Lanes can have serious and unforeseen consequences to CDLs that most attorneys either are unaware of or ignore – to your detriment. Many of these common “reductions” are still considered serious moving violations that result in automatic disqualification or suspension of a CDL by the Bureau of Motor Vehicles (BMV), as well as increasing your insurance premiums to the point you may become un-insurable. Many attorneys fail to even ask their clients whether they have a CDL or are contemplating getting a CDL before pleading them to something that may cost them their license and job.
You need an attorney who really knows the nuances of both the OVI/DUI/DWI laws and the CDL laws to defend you. We are your attorneys. We have found the holes and short-comings of the laws and use them to your advantage to save your license, protect your driving record, and keep you driving.
