Know Your Rights
If questioned by police, you must give your correct personal identification. After you have identified yourself, you do not have to answer any questions without your lawyer present.
You have the right to remain silent — use it. Do not make statements to the police, either written or verbal.
If detained or arrested, keep asking for your lawyer before answering any questions or submitting to any tests.
Do not consent to a search of your car, your person, or your home.
If you are pulled over while driving your car and your sobriety is under suspicion, you do not have to do any field sobriety test. There is no penalty for declining field sobriety tests.
Do not admit to drinking. Be polite, decline field sobriety tests, and ask to speak to your lawyer.
Submitting to a breath, blood or urine test almost NEVER helps your case. Ask to speak with a lawyer before submitting to any tests.
You have the right to an independent chemical test if you are arrested for OVI/DUI/DWI. Tell the officer that you would like to exercise your right to have an independent blood test taken a soon after you are arrested as possible.
